Privacy Notice

This document constitutes the Privacy Notice in accordance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals and its Regulations, as well as other legal regulations that are related to it. Please read carefully the Terms and Conditions contained in this "Privacy Notice", which will apply to any type of personal and/or sensitive information collected by ALPLA, (hereinafter "the responsible party"), in its capacity as responsible party, with address at Manzana 3 Lote 6, Parque Ind. Exportec 1 Toluca, Estado de México C.P. 50200.  

For the purposes of this Privacy Notice, the terms used herein that are not defined herein shall have the meaning attributed to them by law. The purpose of this Privacy Notice is to establish the terms and conditions under which the controller (or the person in charge designated by the controller) (i) will receive and protect your Personal Data, in order to protect your privacy and your right to informational self-determination; (ii) will use your Personal Data and, (iii) will transfer your Data to third parties, if applicable. 

DEFINITIONS 

For the purposes of this Privacy Notice, the following definitions shall apply: "Database": It is the ordered set of personal data concerning an identified or identifiable person.

"Data Blocking": Refers to the identification and preservation of Personal Data, once the purpose for which it was collected is fulfilled, and has the purpose of determining possible liabilities in relation to its processing, until the legal or contractual statute of limitations of these.

"Personal Data": Is any information concerning an identified or identifiable natural person.

"Sensitive Personal Data": Are those personal data that affect the most intimate sphere of its holder, or whose improper use may give rise to discrimination or entail a serious risk to the holder. In particular, sensitive data are considered those that may reveal aspects such as racial or ethnic origin, present or future health status, genetic information, religious, philosophical and moral beliefs, union membership, political opinions and/or sexual preference.

"ARCO Rights": Are the rights of access, rectification, cancellation and, opposition.

"Right of Access": It is the right that the Data Subject has to know about the Personal Data related to his/her person that is held by the Data Controller in question or its Processors, likewise to whom it has been shared and for what purpose.

"Right to Rectification": This is the right of the Data Subject to have his or her Personal Data rectified when it is inaccurate or incomplete.

"Right of Cancellation": This is the right of the Data Subject to request at any time that his or her Personal Data be deleted, which will occur once the blocking period has elapsed.

"Right of Opposition": This is the right of the Data Subject to request, provided he/she has a legitimate cause, that the Controller stops processing his/her Personal Data.

"Responsible": Means the legal entity to which you have provided your personal information and/or have any legal relationship.

"Data Subject": Means the natural person who is the owner of the Personal Data, or authorized to deliver Personal Data of a third party in accordance with the applicable laws, who delivers such Personal Data to the Controller.

PERSONAL DATA COLLECTED AND ITS PURPOSE 

The collection of Personal Data may be carried out through the use of its website. The personal data that the Holder may provide to the responsible, through the website, are: name and email. Such data will have only and exclusively the use described below: 

  1. Information. 
  2. Database Update. 
  3. Any purpose analogous or compatible with the above. 

FOR COMMERCIAL PROSPECTING PURPOSES 

The processing of your Personal Data, which have been made available to the Controller, under any form or circumstance, may be used by the Controller in accordance with these terms and conditions, so that from this moment it is understood that the Data Subject expressly authorizes the Controller for this purpose, until such time as the Data Subject expresses his/her refusal for the processing of his/her personal data in relation to the purposes that are not necessary for the legal relationship, using for this purpose the means indicated in the section "Means to exercise the rights of access, rectification, cancellation or opposition", being his/her manifestation recorded in our exclusion list called "Data subjects excluded from processing". 

TRANSFERS 

The responsible party may transfer your personal data to Mexican or foreign third parties that provide services, as well as to its controlled companies, subsidiaries, affiliates or any company of the same responsible party for such purpose. 

In this case, the responsible party will adopt the necessary measures so that the persons who have access to your personal data comply with the provisions of this privacy notice, as well as with the applicable legal framework. 

HOLDER'S CONSENT

In accordance with article 17 of the law, the Data Subject declares that this Privacy Notice has been made known to him/her by the responsible party, has read, has become familiar with and has understood the terms set forth in this Privacy Notice, and therefore grants his/her consent regarding the treatment of his/her Personal Data, likewise, the Data Subject declares his/her consent for the responsible party or any Responsible Party to transfer Personal Data to national or foreign third parties, in the understanding that the treatment that such third parties give to the Personal Data of the Data Subject shall be in accordance with the provisions of this Notice.  

The Personal Data Subject, at any time, has the right to revoke the consent provided to the data controller for such purpose, using the means to exercise the rights of access, rectification, cancellation or opposition.  

In the event that the Personal Data collected by the data controller includes sensitive Personal Data, in printed format or using electronic media, it shall constitute the express consent of the owner in terms of the second paragraph of Article 8 of the law and other applicable legislation, and therefore grants its consent for the data controller to collect such data.

MEANS TO EXERCISE THE RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION.  

The Data Subject shall at all times have the right to request the data controller to exercise the rights conferred by law, considering for the case of cancellation the provision set forth in Article 26. In the event that the Personal Data had been transmitted prior to the date of rectification or cancellation and continue to be processed by third parties, the data controller shall inform the third party in question of such request for rectification or cancellation, so that it may proceed to carry it out as well.  

The Data Subject may at any time oppose and/or cancel the processing of his/her personal data that may and/or could affect and/or restrict the fulfillment of the contractual and/or commercial relations that he/she has with the responsible party.  

The request shall be in written form and sent to the e-mail address: [email protected] must be accompanied by the documents that prove your identity (i) simple copy in printed or electronic format of your voter's credential, passport or FM-3) (ii) any other element or document that facilitates the location of the Personal Data of the Data Subject.  

The response to your request will be free of charge, and the holder must cover the justified shipping costs or the cost of reproduction in copies or other formats. In the event that the Holder repeats his request for access in a period of less than twelve months, he must cover the corresponding costs equivalent to 1.5 days of the Minimum Wage in force in the City of Mexico. 

Mexico, in terms of article 35 of the law, unless there are substantial modifications to the Privacy Notice that motivate new consultations. 

For purposes of requests for cancellation of Personal Data, in addition to the provisions of this Privacy Notice, the provisions of Article 26 of the law shall apply, including the exceptions to the cancellation of Personal Data indicated therein. 

Data collection when browsing the websites and web pages of the data controller: Among the automatic data capture tools used by the data controller on its websites and web pages are cookies, Web beacons, and links in e-mails. 

Use of Cookies - The correct functioning of the sites of the responsible party and that of its suppliers requires the enabling of "cookies" in your Internet browser. Cookies are small data files transferred by the Web site to your computer's hard drive when you browse the site. Cookies can be either session or persistent. Session cookies do not stay on your computer after you log out of your browser, while persistent cookies stay on computers until you log out.

USE OF WEB BEACONS (ALSO KNOWN AS WEB TAGS, PIXEL TAGS AND CLEAR GIFS) 

The responsible party may use Web beacons, alone or in combination with cookies, on its Web sites and in its HTML-formatted e-mails to collect information about the use of Web sites and your interaction with e-mail. The Web beacon is an electronic image, called a single pixel (1×1) or GIF that can recognize information that is processed on your computer, such as cookies, the time and date the site and its sections are viewed. 

Links in the e-mails of the responsible. - E-mails that include links that allow the controller to know whether you activated the link and visited the destination web page, and this information may be included in your profile. If you prefer that the controller not collect information about your interaction with such links, you may choose to modify the format of the controller's communications (for example, that the message is received in text format rather than HTML format) or you may disregard the link and not access its content. The controller's e-mails may include links designed to direct you to relevant sections of Web sites by redirecting you through the controller's servers. The redirection system allows the controller to modify the URL of such links if necessary, and also allows the controller to determine the effectiveness of its online marketing campaigns. The Personal Data that the Controller collects from your

commercial sources may be used in conjunction with the Personal Data it collects through its websites. For example, the controller may compare disassociated geographic information acquired from commercial sources with the IP address collected by automated data capture tools in order to provide you with information or promotions relevant to your geographic area.  

MODIFICATIONS TO THE PRIVACY NOTICE  

We reserve the right to make changes or updates to this Privacy Notice at any time, in order to comply with new legislation, internal policies or new requirements for the provision or offering of our services or products, so it is the responsibility of the Holder to periodically review the content of the Privacy Notice on the site: https://vidacircular.lat/ In case the Holder does not express any opposition with the modification, the responsible will understand that the Holder has read, understood and agreed to the terms set forth, and which constitutes his express consent to the
